Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website located at polarbearagency.net (the "Site") and the consulting and staffing services described on it (the "Services"), offered by Polar Bear Agency LLC, a Texas limited liability company ("Polar Bear Agency," "we," "us," or "our"). By accessing the Site or engaging our Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

Polar Bear Agency provides IT consulting services — including software development, cloud and DevOps support, and cybersecurity and IT strategy advisory — and technical staffing services, including candidate screening, interview coordination, and technical placement. The specific scope, deliverables, timeline, and fees for any engagement are agreed separately in a project proposal, statement of work, or staffing agreement, which governs alongside these Terms.

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to: submit false or misleading information through our contact form; attempt to gain unauthorized access to any part of the Site or our systems; interfere with the Site's normal operation; or use the Site to transmit any harmful code.

Certain areas of the Site require authentication and are restricted to employees, contractors, candidates, and clients we have approved for access. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account.

The Site, including its text, graphics, logos, and design, is owned by Polar Bear Agency LLC or its licensors and is protected by intellectual property laws. Deliverables produced under a specific engagement are governed by the intellectual property terms of that engagement's agreement, which take precedence over this section for that work.

We treat client project information and candidate information as confidential and use it only to deliver the relevant engagement. A separate non-disclosure agreement is available on request for engagements requiring additional confidentiality assurances.

The Site and general information on it are provided "as is" without warranties of any kind, express or implied. Specific deliverables and service-level commitments are governed exclusively by the signed agreement for that engagement, not by this Site.

To the fullest extent permitted by law, Polar Bear Agency LLC will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Our liability arising from a specific engagement is governed by that engagement's agreement.

You agree to indemnify and hold Polar Bear Agency LLC harmless from any claims, damages, or expenses arising from your misuse of the Site or violation of these Terms.

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Texas.

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
